Why was Don Margera arrested and sued?

Don Margera was arrested on accusations of sexually touching two 12-year-old children on August 18, 2006, in the Colorado Mills Mall in Lakewood, Colorado. He was released after paying $50,000 bail.

Margera was represented during a preliminary hearing on February 1, 2007, by Pamela Mackey, the same lawyer who defended Kobe Bryant in his 2003-2005 sexual assault case. On March 5, 2007, Margera appeared in court for her arraignment and pled not guilty.

On October 22, the trial began in Golden, Colorado. Margera’s lawyer claimed that his client had been playing his “goofy, outrageous, and vulgar” television image for the girls, presenting Margera as a “benign bumbler,” and claiming that Margera’s signature arm movement had been misinterpreted as breast fondling.

The jury began deliberating on the afternoon of October 30, and returned on October 31. Margera was found guilty on two counts of sexual assault on a juvenile but acquitted on the third.

Margera was sentenced to ten years of probation in Pennsylvania in December 2007. He was also prohibited from portraying the character of “Don Vito” in any capacity (appearing on television, authoring books, or holding autograph signings) while serving his term. He was also ordered to register as a sex offender in Colorado and Pennsylvania, to have his mental health evaluated, and to work on his alcohol issues.
