Regarding the promulgation of regulations on dossiers and processing of social insurance benefits

Pursuant to the Law on Social Insurance No. 71/2006/QH11 dated June 29, 2006;
Pursuant to the Government’s Decree No. 152/2006/ND-CP dated December 22, 2006 guiding a number of articles of the Law on Social Insurance regarding compulsory social insurance;
Pursuant to Decree No. 68/2007/ND-CP dated April 19, 2007 of the Government detailing and guiding the implementation of a number of articles of the Law on Social Insurance on compulsory insurance for military personnel and public employees. People’s security and people doing cipher work receive salaries like soldiers and people’s police; Decree No. 153/2013/ND-CP dated November 8, 2013 of the Government amending and supplementing a number of articles of the Government’s Decree No. 68/2007/ND-CP of April 19, 2007;
Pursuant to the Government’s Decree No. 190/2007/ND-CP dated December 28, 2007 guiding a number of articles of the Law on Social Insurance regarding voluntary social insurance; Pursuant to Decree No. 94/2008/ND-CP dated August 22, 2008 of the Government defining the functions, tasks, powers and organizational structure of Vietnam Social Insurance;
Pursuant to Decree No. 49/NQ-CP dated December 9, 2010 of the Government on simplification of procedures falling under the jurisdiction of Vietnam Social Security; Decree No. 48/NQ-CP dated December 9, 2010 of the Government on simplification of administrative procedures under the management function of the Ministry of Labor, War Invalids and Social Affairs;

DECISION
Article 1. To promulgate together with this Decision stipulations on dossiers and process for settling social insurance benefits for employees and employers participating in compulsory social insurance and insurance participants. voluntary social insurance and relatives of employees participating in compulsory social insurance, relatives of participants of voluntary social insurance specified in the Law on Social Insurance.
Article 2. This Decision takes effect from April 1, 2014 and replaces Decision No. 777/QD-BHXH dated May 17, 2010 of Vietnam Social Security; annul Official Letter No. 1094/BHXH-CSXH dated 23/3/2011 of Vietnam Social Security and other regulations contrary to this Decision.
Article 3. Heads of agencies, organizations, employers, employees, participants of voluntary social insurance and heads of units of Vietnam Social Insurance, Directors of Social Insurance of provinces , a city directly under the Central Government, Directors of Social Insurance: Ministry of National Defense, People’s Public Security and Directors of Social Insurance of districts, towns and provincial cities shall base themselves on this Decision to implement./.

GENERAL PROVISIONS
Article 1. Subjects of application
Dossier and process for settling social insurance benefits specified in this document apply to employees, employers participating in compulsory social insurance and participants in voluntary social insurance, relatives of social insurance participants, social insurance organizations, relevant agencies, units and local authorities in making dossiers and handling social insurance benefits according to regulations of the Law on Social Insurance.
Article 2. Interpretation of terms
1. The place of residence specified in this document and in the forms and forms enclosed with this document shall be understood as the lawful place of residence according to the provisions of law (the place of permanent residence or the place of temporary registration). residence). Article 3. Dossier, time limit for settlement of social insurance benefits and responsibility for making and receiving dossiers
1. Dossier and time limit for settlement of sickness benefits, maternity benefits, occupational accident and occupational disease regimes, retirement benefits and survivorship regimes must comply with the provisions of the Law on Insurance Social Security and Resolution No. 48/NQ-CP, Resolution No. 49/NQ-CP dated December 9, 2010 of the Government on simplification of administrative procedures in the field of social insurance.
2. Employees, employers, Social Insurance organizations, relevant individuals, organizations and local authorities when providing, declaring, certifying and making dossiers must fully record, accurately, in accordance with the authority and responsible before the law.
3. Employees, employers and related individuals shall receive back the settled dossiers for social insurance benefits at the places where the dossiers of application for settlement have been submitted.
4. The process of transferring dossiers between the dossier-receiving department and the professional divisions or the professional division shall comply with current regulations on receipt of dossiers and return of results for settlement of insurance administrative procedures. social insurance, health insurance.
Article 4. Samples and forms of dossiers for settlement of entitlement to social insurance regimes

Article 7. Personal responsibilities in settling social insurance regimes
For cases of wrong handling of the social insurance regime under the authority of the Social Insurance agency, leading to financial loss, the loss amount must be fully recovered; In case the paid amount cannot be recovered, the individual civil servant or public employee concerned shall make an error in the process of collecting and issuing social insurance books, settling and paying social insurance benefits. Article 8. Dossier for settlement of sickness benefits
1. Dossiers for settlement of benefits for employees who fall ill due to accidental accidents or suffer from common diseases that are not on the list of diseases requiring long-term treatment and leave to take care of sick children, including:
1.1. Social insurance book.
1.2. One of the following documents:
a) Hospital discharge paper (original or copy) in case the employee or the employee’s child is inpatient;
b) Certificate of leave of absence enjoying social insurance in case the employee or the employee’s children receive outpatient treatment (form C65-HD) or medical examination and treatment papers (original or copy), book child’s medical examination and treatment (original or copy) showing full information about the mother or father’s full name; the name, age of the child, the number of days needing child care leave;
c) A certified Vietnamese translation (original or copy) of the medical examination and treatment certificate issued by a foreign medical facility for medical examination and treatment abroad.

Chapter 1.
GENERAL PROVISIONS
Article 1. Subjects of application
Dossier and process for settling social insurance benefits specified in this document apply to employees, employers participating in compulsory social insurance and participants in voluntary social insurance, relatives of social insurance participants, social insurance organizations, relevant agencies, units and local authorities in making dossiers and handling social insurance benefits according to regulations of the Law on Social Insurance.
Article 2. Interpretation of terms
1. The place of residence specified in this document and in the forms and forms enclosed with this document shall be understood as the lawful place of residence according to the provisions of law (the place of permanent residence or the place of temporary registration). residence). One person at a time only resides either at the place of permanent residence or at the place of temporary residence registration.

Article 3. Dossier, time limit for settlement of social insurance benefits and responsibility for making and receiving dossiers

Dossier and time limit for settlement of sickness benefits, maternity benefits, occupational accident and occupational disease regimes, retirement benefits and survivorship regimes must comply with the provisions of the Law on Insurance Social Security and Resolution No. 48/NQ-CP, Resolution No. 49/NQ-CP dated December 9, 2010 of the Government on simplification of administrative procedures in the field of social insurance.
2. Employees, employers, Social Insurance organizations, relevant individuals, organizations and local authorities when providing, declaring, certifying and making dossiers must fully record, accurately, in accordance with the authority and responsible before the law.
3. Employees, employers and related individuals shall receive back the settled dossiers for social insurance benefits at the places where the dossiers of application for settlement have been submitted.
4. The process of transferring dossiers between the dossier-receiving department and the professional divisions or the professional division shall comply with current regulations on receipt of dossiers and return of results for settlement of insurance administrative procedures. social insurance, health insurance.
Article 4. Samples and forms of dossiers for settlement of entitlement to social insurance regimes

2. Article 5. Regulations on the number of dossiers for enjoying social insurance regimes and social insurance books

Article 7. Personal responsibilities in settling social insurance regimes
