Waititi successfully defeated Labour MP Tmati Coffey in the 2020 election, winning by 836 votes, and was elected as the representative for Waiariki.

According to the final election results, the Mori Party received 1.2% of the party vote, giving them the right to two seats. Waititi’s victory in the electorate therefore meant that Debbie Ngarewa-Packer, his female co-leader, would also be sworn in as a member of parliament.

Two from the Mori Party are among the forty-two new MPs elected to the 53rd Parliament. The Māori Party’s constitution mandates that its co-leaders, one male and one female, be chosen from its MPs first.

Waititi was elected as the male co-leader of the party, succeeding his father-in-law John Tamihere, at a special general meeting of the party held on October 28, 2020.

Waititi took part in talks with 16 inmates who had been involved in the disturbance at Waikeria Prison because of claims of harsh and filthy circumstances there at the end of December 2020 and the beginning of January. Several of the prisoners had requested the presence of a Māori leader such as Waititi as a prerequisite to ending the unrest.

Waititi was dismissed from the House of Representatives on February 9 by Speaker Mallard because he refused to adhere to the professional clothing code by donning a necktie. Waititi chose to don a hei tiki necktie in place of that, which he characterized as Māori business attire.

After a disagreement with Judith Collins, the leader of the opposition National Party, about the formation of a Mori Health Authority, Waititi was removed from the 12 May session of parliament.

Waititi and colleague Mori Party MP Ngarewa-Packer opposed the Queen Elizabeth II Memorial Day Act 2022, which established a one-time public holiday on September 26 to honor the monarch’s demise.

Waititi was given a 24-hour suspension from the House of Representatives on August 29, 2023, for making a reference to secret judicial proceedings while posing a query.

Waititi violated two parliamentary standing orders by mentioning the judicial proceedings even though the question was posed in accordance with parliamentary privilege. Speaker Rurawhe also submitted a “general question” about violating judicial suppressions to the Privileges Committee of Parliament.
