Attorney General Merrick Garland designated Hur on January 12, 2023, to lead the US Department of Justice’s inquiry into President Joe Biden’s purportedly improper handling of sensitive data while serving as vice president.

On February 7, 2024, Garland informed Congress that Hur had completed his inquiry and that no charges were suggested. Hur said that he had “evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen” in the final report that brought his inquiry to an end.

His conclusion was that “Biden would likely present himself to a jury… as a sympathetic, well-meaning, elderly man with a poor memory.” He also mentioned Biden’s memory as a contributing factor.

Hur’s description was criticized by the White House as improper, politicized commentary that deviated from standards of objective, legal analysis.
